Right of Withdrawal

NorrChemica™ supplies research-grade chemicals and laboratory reagents, and provides laboratory analysis services, to universities, research institutions, companies, and individual purchasers. The information below sets out the statutory right of withdrawal, the purchasers to whom it applies, and the circumstances in which it does not apply to the goods and services we provide.

Statutory right of withdrawal

Where a purchaser qualifies as a consumer under Directive 2011/83/EU (the Consumer Rights Directive), as transposed into national law, that purchaser has a right to withdraw from a distance contract within 14 days, without giving any reason, save where one of the statutory exceptions applies. For contracts for goods, this period runs from the day the goods are received; for contracts for services, it runs from the day the contract is concluded. To exercise this right, a purchaser may use the withdrawal function available on this website, or the model withdrawal form below, and we will acknowledge receipt on a durable medium without undue delay.

Goods: chemicals and laboratory reagents

Under Article 16 of Directive 2011/83/EU, as transposed into national law, the right of withdrawal does not apply to, among others:

  • the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene and which were unsealed after delivery;
  • the supply of goods made to the consumer's specifications or clearly personalised;
  • the supply of goods which are liable to deteriorate or expire rapidly.

Research chemicals and laboratory reagents supplied by NorrChemica are provided in sealed containers and, once unsealed, cannot be returned for reasons of health protection, hygiene, and product integrity. Quantities prepared or weighed to order are goods made to the purchaser's specification. Accordingly, such goods are exempt from the right of withdrawal under the provisions above. This does not affect any rights a consumer may have in respect of goods that are defective or not as described.

Services: NMR analysis and other laboratory services

Where a consumer purchases a service from us at a distance — such as our NMR analysis service — the 14-day right of withdrawal applies to the service contract, and the period runs from the day the contract is concluded.

Because our analysis services begin promptly once an order is confirmed, we ask a consumer, at the point of instructing us to proceed, to expressly request that performance of the service begin within the 14-day withdrawal period, and to acknowledge that the right of withdrawal will be lost once the service has been fully performed. Under Article 16(a) of Directive 2011/83/EU, as transposed into national law, the right of withdrawal does not apply to a service contract that has been fully performed where performance began with the consumer's prior express consent and acknowledgement to that effect.

If a consumer who has requested that performance begin during the withdrawal period exercises the right of withdrawal before the service has been fully performed, that consumer remains liable for an amount proportionate to the service already provided up to the time we are informed of the withdrawal, in comparison with the full contract, including any courier, handling, and third-party acquisition costs incurred on the consumer's behalf. This does not affect any rights a consumer may have in respect of a service that is defective or not as described.

Business purchasers

The statutory right of withdrawal applies to consumers. Purchasers acting in the course of a trade, business, profession, or institutional research activity are not consumers for this purpose, and the right of withdrawal does not apply to such purchases.
